Terms and Conditions

Last updated July 13, 2026. These Terms govern use of kontaq websites, mobile apps, guest-facing service pages, dashboards, demos, and related services.

1. Acceptance of these Terms

These Terms and Conditions are an agreement between you and kontaq, operated by Solvusoft Corporation, and apply when you access or use our websites, mobile applications, guest-facing service pages, dashboards, demos, content, communications, and related services. If you use kontaq on behalf of a company, hotel, resort, property, or other organization, you represent that you are authorized to accept these Terms on its behalf.

2. Other agreements may apply

A paid pilot, subscription, enterprise rollout, order form, statement of work, data processing agreement, or other written agreement may include additional or different terms. If there is a conflict between these Terms and a signed written agreement with kontaq, the signed agreement controls for that customer relationship.

3. The kontaq service

kontaq provides app-free guest service pages, resort directory content, communication tools, routing workflows, dashboard features, analytics, and related functionality that help properties connect rooms, cabanas, tables, amenities, and other touchpoints to the teams that serve them. Features may vary by property, plan, module, deployment, device, geography, and rollout scope.

4. User roles

kontaq may be used by property owners, operators, administrators, staff members, vendors, guests, visitors, and website users. Property users may manage pages, content, staff routing, messages, calls, files, links, analytics, and account settings. Guest users may interact with guest-facing pages without downloading an app, depending on how a property has configured the service.

5. Customer and property responsibilities

Properties and customer organizations are responsible for the accuracy, legality, and appropriateness of the content, links, files, menus, offers, hours, policies, service actions, routing rules, staff assignments, and guest-facing pages they create or approve. Properties are also responsible for training their teams, responding to guest communications, honoring offers, and complying with hospitality, consumer protection, accessibility, employment, privacy, and other laws that apply to their operations.

6. Accounts and security

You are responsible for keeping account credentials secure and for activity that occurs through your account or workspace. You agree to provide accurate account information, use appropriate permissions for staff and administrators, and notify kontaq promptly if you believe an account, device, credential, or workspace has been compromised.

7. Guest communications and service requests

kontaq helps route guest communications and requests, but kontaq does not guarantee that a property, staff member, vendor, or third-party service will respond within any specific timeframe. Properties remain responsible for their guest service operations, staffing decisions, fulfillment, quality standards, and response practices.

8. No emergency or life-safety use

kontaq is not an emergency, medical, security, fire, life-safety, or law-enforcement service. Do not use kontaq as the only way to request emergency help or urgent safety assistance. In an emergency, users should contact local emergency services, property security, front desk staff, or other appropriate emergency channels directly.

9. Acceptable use

You may not misuse kontaq or use it to violate laws, infringe rights, harass others, send unlawful or abusive content, impersonate someone, upload malicious code, interfere with the service, attempt unauthorized access, scrape data without permission, bypass security controls, or use kontaq in a way that harms guests, staff, properties, kontaq, or third parties.

10. Content and permissions

You retain ownership of content you submit or manage through kontaq, such as property information, service descriptions, logos, images, files, menus, links, messages, and feedback. You grant kontaq a limited license to host, process, display, transmit, store, and use that content as needed to provide, secure, support, and improve the service. You are responsible for having the rights and permissions needed to submit that content.

11. Third-party services and links

kontaq may connect to or link with third-party services such as messaging, calling, video, maps, translation, analytics, hosting, email, payment, booking, ordering, property systems, and external websites. Third-party services are governed by their own terms and privacy practices, and kontaq is not responsible for their availability, accuracy, security, or performance.

12. Fees, subscriptions, and pilots

Fees, billing cycles, setup charges, pilot scope, modules, usage limits, taxes, renewal terms, cancellation rights, and payment obligations are governed by the applicable order form, subscription terms, invoice, or written agreement. Unless a written agreement says otherwise, fees are non-refundable once paid and may change for future renewal periods or expanded deployments.

13. Product changes and beta features

kontaq may add, modify, suspend, or discontinue features, designs, modules, integrations, pricing, plans, or documentation as the service evolves. Pilot, beta, preview, experimental, or newly released features may be incomplete, may change quickly, and may be provided for evaluation without the same commitments as generally available features.

14. Intellectual property

kontaq and its software, designs, workflows, visual assets, documentation, trademarks, logos, names, technology, and know-how are owned by kontaq or its licensors. Except for the limited right to use the service under these Terms or a written agreement, no rights are transferred to you. Feedback, suggestions, or ideas you provide may be used by kontaq without restriction or compensation.

15. Privacy and account deletion

Use of kontaq is also governed by our Privacy Policy. Users may request deletion of their kontaq account and associated information by visiting https://kontaq.com/data-deletion-request/ or emailing support@kontaq.com with the subject line “Delete my kontaq account and all information.” We may retain limited information where required or permitted for legal, security, fraud-prevention, dispute-resolution, tax, accounting, compliance, backup, or legitimate business purposes.

16. Suspension and termination

kontaq may suspend or terminate access to the service if we believe these Terms have been violated, payment is overdue, continued access creates risk, legal compliance requires it, or a customer agreement ends. You may stop using kontaq at any time, and customer cancellation rights are governed by the applicable written agreement.

17. Disclaimers

To the fullest extent permitted by law, kontaq is provided on an “as is” and “as available” basis. We do not promise that the service will be uninterrupted, error-free, secure, compatible with every system, or suitable for every property, workflow, device, location, guest expectation, or business outcome. Product descriptions, demos, pricing materials, and examples are informational and may not reflect every deployment.

18. Limitation of liability

To the fullest extent permitted by law, kontaq and its owners, employees, contractors, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost revenue, lost data, lost goodwill, guest dissatisfaction, missed business opportunities, or service interruptions. For paid customer relationships, kontaq’s total liability will not exceed the amounts paid to kontaq for the affected service during the twelve months before the claim, unless a written agreement states otherwise.

19. Indemnification

You agree to defend, indemnify, and hold kontaq harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, your misuse of the service, your violation of these Terms, your violation of law, your infringement of third-party rights, or service operations controlled by your property or organization.

20. Governing law and disputes

Unless a written agreement states otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be handled in the state or federal courts located in California, unless applicable law or a written agreement requires a different forum.

21. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of kontaq after updated Terms are posted means you accept the updated Terms.
